Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Azdawaj Technologies Private Limited ("Azdawaj", "we", "us", or "our") governing your use of the Azdawaj matrimonial platform available at azdawaj.com and related services (collectively, the "Service").

By registering for an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

To use Azdawaj, you must meet all of the following eligibility requirements:

• You must be at least 18 years of age.
• You must be a member of the Shia Muslim community (Ithna Ashari, Ismaili, Zaydi, Bohra, or related communities).
• You must be legally permitted to enter into a binding agreement under the laws of your jurisdiction.
• You must not be prohibited from using the Service under any applicable laws.
• You must not have a previously terminated or banned account on Azdawaj.
• You must provide accurate, truthful, and up-to-date information during registration.
• You must be genuinely seeking a matrimonial partner and not using the platform for any other purpose.

Azdawaj reserves the right to verify eligibility at any time and to refuse access or terminate accounts that do not meet these criteria, without prior notice or refund.

3.1 Registration: You agree to provide accurate, current, and complete information during registration and to keep this information up to date. Providing false information, including age, identity, or marital status, is a material breach of these Terms.

3.2 One account per person: Each individual is permitted only one active account. Creating multiple accounts, or creating an account on behalf of another person without explicit permission, is prohibited.

3.3 Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us at security@azdawaj.com if you suspect any unauthorised use of your account.

3.4 Verification: You agree to complete identity verification when requested. Providing fraudulent verification documents is a criminal offence and will result in immediate permanent account termination and reporting to relevant authorities.

By using Azdawaj, you agree to use the Service lawfully and respectfully. The following are strictly prohibited:

Prohibited behaviour:

• Impersonating any person or entity, or misrepresenting your identity, age, religion, marital status, or any other information.
• Uploading photos that are not of yourself, that are sexually explicit, or that contain nudity.
• Sending unsolicited messages, spam, chain letters, or commercial solicitations.
• Harassing, threatening, intimidating, or abusing other members in any way.
• Soliciting money, financial assistance, or gifts from other members.
• Using the platform for escort services, commercial dating, or any non-matrimonial purpose.
• Collecting or harvesting information about other users without consent.
• Using automated tools (bots, scrapers, crawlers) to access or interact with the Service.
• Attempting to reverse-engineer, decompile, or access non-public parts of the Service.
• Uploading malware, viruses, or any harmful code.
• Violating any applicable local, national, or international laws or regulations.
• Promoting extremism, terrorism, violence, or hate speech.

5.1 Your responsibility: You are solely responsible for all content you submit to the Service, including your profile, photos, messages, and any other material ("User Content"). You represent and warrant that you own or have the necessary rights to submit all User Content and that it does not infringe any third-party rights.

5.2 Licence to Azdawaj: By submitting User Content, you grant Azdawaj a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Service.

5.3 Content standards: All User Content must be honest, respectful, and appropriate. We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms, our community guidelines, or applicable law.

5.4 No endorsement: Azdawaj does not endorse, verify, or guarantee the accuracy of any User Content. We strongly encourage you to exercise your own judgement and conduct due diligence before entering into any real-world meetings.

6.1 Free tier: A basic free account allows you to create a profile, browse matches, and express interest. Certain features are reserved for Premium subscribers.

6.2 Premium subscriptions: Premium plans are billed monthly or annually at the rates shown on the Premium page at the time of purchase. All prices are inclusive of applicable taxes.

6.3 Auto-renewal: Premium subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before renewal.

6.4 Cancellation: You may cancel your subscription at any time via Profile → Settings → Subscription. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription time except as set out in the refund policy below.

6.5 Refund policy: New subscribers are eligible for a full refund within 7 days of their first Premium purchase if they are not satisfied. After 7 days, no refunds are issued for any reason. To request a refund, email billing@azdawaj.com within 7 days of purchase.

6.6 Price changes: We reserve the right to change subscription pricing at any time. Any price change will be communicated at least 30 days in advance and will apply from the next renewal date.

Your safety is our highest priority. We encourage all members to follow these safety guidelines:

• Never share your home address, financial information, or workplace details in your profile or early conversations.
• Meet potential partners for the first time in a public place with a trusted friend or family member present.
• Trust your instincts — if something feels wrong, end the conversation and report the user.
• Never send money to someone you have met through Azdawaj, regardless of the circumstances.
• Inform a trusted person about your plans before meeting anyone from the platform.

Reporting: You are encouraged to report any member who you believe is fake, abusive, harassing, or otherwise violating these Terms. Reports can be made via the flag icon on any profile or message. All reports are reviewed by our team within 24 hours.

Moderation: Azdawaj operates a zero-tolerance policy for harassment, abuse, and fraudulent activity. We reserve the right to remove any profile and ban any user who is found to be in violation, without prior notice or refund.

The Service and all of its original content (excluding User Content), features, and functionality — including but not limited to the Azdawaj name and logo, software, design, text, graphics, and algorithms — are and will remain the exclusive property of Azdawaj Technologies Private Limited and its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended personal, non-commercial matrimonial purpose. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer or attempt to extract the source code, without our express written permission.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, Azdawaj disclaims all warranties including but not limited to:

• Any warranty that the Service will be uninterrupted, error-free, or secure.
• Any warranty regarding the accuracy, reliability, or completeness of any content.
• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Any guarantee that use of the Service will result in a match or marriage.

Azdawaj is a platform that facilitates connections. We do not conduct background checks on all members and cannot guarantee the character, intentions, or identity of any user. Members use the Service at their own risk.

To the maximum extent permitted by applicable law, Azdawaj and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages resulting from your access to or use of (or inability to access or use) the Service.
• Damages resulting from any conduct or content of any third party on the Service.
• Damages resulting from any meeting, interaction, or relationship that originated through the Service.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) INR 5,000 or (b) the total amount you paid to Azdawaj in the 12 months preceding the claim.

11.1 By you: You may close your account at any time by going to Profile → Settings → Delete Account. Deletion is permanent and irreversible.

11.2 By Azdawaj: We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason in our sole discretion. Termination for cause does not entitle you to any refund.

11.3 Effect of termination: Upon termination, your right to use the Service ceases immediately. Sections 5.2, 8, 9, 10, and 12 survive termination.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

If you are a consumer resident in the EU or UK, you may also be entitled to bring proceedings in the courts of your country of residence under applicable consumer protection laws.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via email at your registered address at least 30 days before the changes take effect.
• Display a prominent in-app notice for at least 30 days.

If you do not agree to the revised Terms, you must stop using the Service and delete your account before the effective date. Continued use after the effective date constitutes acceptance.
